Policy 121 Revised 01/2022

An LEA shall publicize the SARC for each school, and notify parents or guardians of students that a hard copy will be provided upon request. An LEA that is connected to the internet shall make the information contained in the SARC accessible on the internet and make the information widely available through public means.

(20 U.S.C. Section 6311[h][2][B][iii]; EC sections 35256[c], 35258.)

The LEA's nondiscrimination, harassment, intimidation, and bullying policies shall be readily accessible in a prominent location on the LEA's existing internet website in a manner that is easily accessible to parents/guardians and pupils.

(EC Section 234.6(b)(8))

The LEAs shall post a link to statewide resources, including community-based organizations, which shall be readily accessible in a prominent location on the LEA's internet website in a manner that is easily accessible to parents/guardians and pupils. The LEA shall also include any additional information deemed important for preventing bullying and harassment.

(EC Section 234.6(b)(11-12))

The LEA shall adopt procedures for preventing acts of bullying, including cyberbullying. (EC Section 234.4(a))

(a) The LEA's anti-cyberbullying procedures shall be readily accessible in a prominent location on the LEA's existing internet website in a manner that is easily accessible to parents/guardians and pupils.

(EC Sections 234.4 and 234.6(a)(1))

(b) The website shall also include a section on social media bullying that includes all of the following references to possible forums for social media bullying:

i.  Internet websites with free registration and ease of registration.
ii.  Internet websites offering peer-to-peer instant messaging.
iii.  Internet websites offering comment forums or sections.
iv.  Internet websites offering image or video posting platforms.

(EC Section 234.6(9) and (10)(A-D)

The LEA's written policy on sexual harassment, as it pertains to pupils, shall be readily accessible in a prominent location on the LEA's existing internet website in a manner that is easily accessible to parent/guardians and pupils.

(EC Section 234.6(b)(6))

The LEA's policy on pupil suicide prevention in grades 7-12, inclusive, shall be readily accessible in a prominent location on the LEA's existing internet website in a manner that is easily accessible to parents/guardians and pupils. 

(EC Section 234.6(b)(2))

The LEA shall post the following Title IX requirements in a prominent and conspicuous location on the LEA's existing web page:

(a) The name and contact information of the Title IX coordinator that public school, school district, county office of education, or charter school which shall include the Title IX coordinator's phone number and email address.

(b) The rights of a pupil and the public and the responsibilities of public school, school district, county office of education, or charter school under Title IX, which shall include, but shall not be limited to, internet web links to information about those rights and responsibilities located on the internet websites of the department's Office of Equal Opportunity and the U.S. Department of Education (ED) Office of Civil Rights (OCR), and the list of rights specified in EC Section 221.8.

(c) A description of how to file a complaint under Title IX, which must include the following:

i. An explanation of the statute of limitations within which a complaint must be filed after an alleged incident of discrimination has occurred, and how a complaint may be filed beyond the statue of limitations.
ii. An explanation of how the complaint will be investigated and how the complainant may further pursue the complaint including, but not limited to, internet web links to this information on the U.S. ED OCR's internet web site.
iii. An internet web link to the ED OCR complaints form, and the contact information for the office, which shall include the phone number and email address for the office. 
(EC Section 221.61).

The LEA shall post a link the CDE's Title IX information in a prominent location on the LEA's existing internet website in a manner that is easily accessible to parents/guardians and pupils.
(EC Section 234.6(b)(5))

The LEA ensures that each public elementary school, secondary school, and charter school offering competitive athletics shall make all of the following information publicly available at the end of the school year:
(1) total enrollment of the school, classified by gender; (2) number of pupils enrolled at the school who participate in a competitive athletics, classified by gender; and (3) number of boys' and girls' teams, classified by sport and competition level.
(EC Section 221.9(a-c))
(a) The information shall reflect the total number of  players on a team roster on the first official day of team competition. (EC Section 221.9(b))
(b) This information shall be posted on the school's internet website, or if the school does not maintain an internet website, on the district or charter schools' internet website and the information for each school shall be listed individually. (EC Section 221.9(c))
(c) All materials used to compile each school's information shall be retained by the school for minimum of three years after the information is posted on the Internet. (EC Section 221.9(d))

21st CCLC, ASSETs-The program developed by the LEA/grantee agency meets evaluation requirements and principles of effectiveness:
(h) The results of evaluations are made available to the public upon request with public notice of such availability provided.

(20 U.S.C. Section 7175 [b][1]-[2]) (20 U.S.C. Section 7175[b][2][B][ii])

The LEA shall prioritize funds to schools served by the agency that are implementing comprehensive support and improvement activities and targeted support and improvement activities and have the highest percentage of children counted under Title I, Part A.

LEA policies and procedures provide the UCP Annual Notice:
(f) Annual dissemination of written notice I of the LEA's complaint procedures
(g) The notice may be available on the LEA's website.
(h) The notice includes the following:

i. To all students, employees, parents or guardians of its students, school and district advisory committee members, appropriate private school officials or representatives, and other interested parties that includes information regarding allegations about discrimination, harassment, intimidation, or bullying.
ii. The list of all federal and state programs within the scope of the UCP
iii. The title of the position whose occupant is responsible for processing complaints, and the identity(ies) of the person(s) currently occupying that position, if known...

Annual written notice I of the complaint procedures shall be in English, and when necessary, in the primary language, pursuant to section 48985 of the EC or mode of communication of the recipient of the notice.

(a) The UCP Annual Notice may be made available on the LEA's website.

f. The UCP Annual Notice may be posted on the LEA website, but must, in addition, be distributed to all employees, students, parents/guardians, advisory committee members, private school officials (if any) and other interested parties with access thereof in a tangible format.
